Chapter I General Provisions

Chapter II Organization and Responsibility

Article 5 The Ministry of Chemical Industry shall lead the emergency rescue work for chemical accidents in the chemical industry throughout the country.

Its main responsibilities:

1. Implement national regulations on the prevention and rescue of chemical accidents.

2. Prepare the emergency rescue work plan for chemical accidents and formulate a chemical accident emergency rescue plan for the Ministry of Chemical Industry.

3. Organize the handling of major chemical accidents and the implementation of emergency rescue.

4. Conduct investigations on major chemical accidents and organize the restoration of production.

5. Organize chemical accident prevention and emergency rescue research. In order to strengthen technical guidance and interregional rescue, the Regional Chemical Accident Emergency Rescue Center of the Ministry of Chemical Industry was established.

Article 6 The chemical departments ( bureaus and head offices ) of provinces, autonomous regions, and municipalities directly under the Central Government shall lead the emergency rescue work of chemical accidents in this province, autonomous region, and municipality directly under the Central Government. Chapter 3 Emergency Rescue

Article 8 When any unit or individual discovers a chemical accident, it shall promptly report an alarm.

Article 9 Organization Implementation:

1. When a chemical accident occurs, when the accident unit reports to the next level, it should immediately follow the emergency rescue plan, organize and direct various rescue teams and employees of the unit to take measures to control the source of the hazard. 2. After receiving the accident report, the chemical departments ( bureaus and head offices ) of provinces, autonomous regions, and municipalities directly under the Central Government shall, except for reports to the Ministry of Chemical Industry for major or catastrophic chemical accidents, immediately adjust the amount of power to organize the rescue within the industry and at the same time Acute poisoning emergency rescue center contacted for rescue.

3. Article 10 Investigation and Closure of Chemical Accidents

The emergency response team for chemical accidents at the accident unit shall report the accident investigation report and the result to the leading chemical institution at the next level after the accident is handled, and copy the chemical occupation prevention at the Chemical Department ( Bureau, Head Office ) of the province, autonomous region and municipality directly under the Central Government . Chapter IV Management of Emergency Rescue

Article 12 Contents of Emergency Rescue Plans for Chemical Accidents:

1. Basic situation.

Article 13 The employees shall carry out publicity and education on prevention, self-rescue and mutual rescue of chemical accidents.

Chapter V Equipment and Expenses

Article 17 Equipment

1. 3. Protective equipment: Each rescue team should be equipped with appropriate personal protective equipment, such as protective masks and protective clothing.

Article 18 funds

1. Enterprises and institutions shall ensure the necessary funds for emergency rescue of chemical accidents.

2. The expenses incurred by the emergency rescue center's rescue shall be paid by the unit where the accident occurred.

Chapter 6 Rewards and Penalties

Article 19 Units and individuals that have made outstanding achievements in the emergency rescue work of chemical accidents shall be commended and rewarded by the superior department in charge of the unit.

Article 20 The medical treatment and pension benefits for those who are injured, maimed or sacrificed in an emergency rescue shall be handled in accordance with the provisions of the State concerning injury, disability or sacrifice due to the public.

Article 21 Where in the emergency rescue work of a chemical accident, when the preparation work and the accident are not completed due to dereliction of duty, conceal the facts, misrepresent the facts, lead to the command rescue work mistakes, cause serious consequences, and an excuse for rescue operations. Escape, get away or refuse to implement the rescue order, should be given the necessary punishment until the legal responsibility.

Chapter VII Supplementary Provisions

Article 22 The present Measures shall be interpreted by the Ministry of Chemical Industry.

Article 23 Enterprises and institutions affiliated to the non-chemical department that produce, transport, store, or use chemical dangerous goods, including Chinese-foreign joint ventures, wholly foreign-owned enterprises, and township-and-town enterprises may refer to these Measures to implement emergency rescue of chemical accidents.

Article 24 These Measures shall be implemented as of the date of promulgation.
